The police officers arrest the offenders and charge the offender with the crime, and the court yester determines what sentence the offender should face, If the charges warrant a sentence. If the offender receives a sentence of Call or prison, the correctional faculties must guarantee the sentence occurs In a secure manner. Unfortunately, these criminal Justice agencies are not always working toward the same goals, which results in conflict. We will write a custom essay sample on Leading Group Challenges or any similar topic only for you Order Now The leaders of the agencies must take care of the conflict before the conflict is out of hand. An example of the type of conflict that may arise is police officers wanting to remove the offenders off the streets. The court system may want o give the offenders a chance at rehabilitation instead of prison time, even if the offender is a repeat offender. Situations like this cause conflict for the leaders of the criminal Justice agencies to handle. The court system, correctional facilities, and police give up a considerable amount of control with the responsibilities. Leadership among criminal Justice agencies must consider the control with Justice (Collaborative Justice, 2012). Criminal Justice agencies must work together Instead of against each other to handle the challenges with conflict and control. The agencies must be on the name page and working toward the same goals. The ultimate goal Is to rehabilitate offenders but at times there will be an offender who is not a candidate for rehabilitation. The agencies must work together to find the best solution for the offender, society, and for the different agencies involved (Collaborative Justice, 2012). Political Challenges Criminal Justice agencies handle political and legal challenges that take place inside as well as outside the criminal justice system. Criminal justice decision makers are chosen through appointment or election. Depending on the state, the Judges are either voted in by the people or the governor appoints who he or she wants as a judge. No matter how a person looks at it, either way Is political. The president of the united States appoints the federal Judges, and he or she Is verified by the Senate. The political process strongly persuades the Supreme Court of the united States (Dulled, 2012). Keeping politics out of the various criminal Justice agencies Is a must. These agencies have a job to do, which cannot happen if the politics are in the way of people, with that, the politics must stop. The United States has too many corrupt officials because he or she allowed politics to get in the way of doing the Job. There are politics in the police, prosecution, and corrections. For good things to happen with these agencies in the future, these agencies need to separate the politics from the Job and purpose of the Job (Dueling, 2012). The Police and Politics Politics does not have a direct effect on the daily routines and decisions of police officers but politics does determine how the police officers act and react during patrol. Police departments are run by some form of government, whether it is the city council, the mayor, the city manager, or the commissioner. These leaders make a change in the degree to which politics shape the police departments. Politics floods police departments in cities and towns that have a government that consists of a city council or a mayor making the decisions. Professional city managers make political involvement with the police departments less possible (Dueling, 2012). The Prosecution and Politics Political deliberations sway prosecutors in an exact way. Most states elect the prosecutors, and the prosecutors are caught up in the local politics. In the federal courts, the attorneys for the United States are appointed politically and are likely to outwork his or her career goals to the wants of his or her own political affiliation. The federal and state prosecutors frequently use his or her headquarters as a launch pad for a higher political office. Infrequently, a dishonest prosecutor will take advantage of his or her power by way of engaging in political actions of pressing outrageous charges against his or her enemies (Law. ]rank. Org, 2012). Corrections and Politics Officials in the corrections facilities take political concerns into consideration. Politics can push release decisions from the parole board. The members of the parole board re vulnerable to pressure from the authority that chooses him or her. The members of the parole board almost unavoidably make the decisions to release an offender carefully. If a parolee commits a crime after he or she was paroled, the media will put the blame on the governor, and the rivals of the governor will use that against the governor in the next election (Dueling, 2012). Communication Challenges Communication is one of the biggest challenges facing leaders in criminal Just agencies. There are two communication barriers that affect communication within these agencies. The first barrier is the individual barriers. The individual barriers deal with how a person interprets what someone else says and the organizational barriers come from the culture of an organization. Each criminal Justice agency has one goal in mind, to protect the people. However, each agency has its own language of sorts when handling the tasks within the agency. The police departments, the court system, and corrections have different languages and not all agencies are familiar with each language. This is a challenge when the agencies must work together. This communication challenge also can be a problem for the public if the public does not know or understand what the agencies are discussing (Sinclair, 2012). Communication is vital to any agency, especially criminal Justice agencies. Every criminal Justice agency has a purpose to protect the people of the United States. Various agencies should hold a training session together to discuss the communication issues between the various agencies and train each agency on the different languages of each agency. These agencies need to work together, which cannot happen if there is a lack in communication (Sinclair, 2012). Budget Challenges Budget cuts occur across the nation and criminal Justice agencies are not exempt room budget cuts. Most criminal Justice agencies rely on local and state funding to operate and sometimes the state or local officials have to make drastic cuts to the budget because of the economy. Unfortunately, this causes a reduction in staff because the money Just is not there to pay the salaries. Budget cuts are probably the biggest challenges that criminal Justice leaders face because no one wants a reduction in police officers or correctional officers. The United States needs every man power it can get to combat the war on crime. The crime rate rises when departments are forced to scale back because of the budget. Offenders on parole or probation receive less supervision because the money is not there to supervise adequately each offender. Budget cuts affect each agency differently, but no agency wants the budget to be cut because managers believe the public cannot be adequately protected (Bryant, 2012). Unfortunately, budget cuts happen to the criminal Justice agencies whether the agencies want it or not. Along with these budget cuts come a reduction in staff. That is a huge blow to law enforcement agencies hired to serve and protect the people of the United States. Criminal Justice agencies discuss and are given a budget after each fiscal year. The budget covers salaries, overtime, and various expenses for the department. The different departments must figure out ways to deal with budget cuts properly to ensure no reduction to the current staff. Sticking to the budget and using the budget for things necessary is important. Having an agency leader make drastic changes to the agency just because he or she wants to, is not a good way to spend the budget (Bryant, 2012). Effective Team Challenges Most criminal Justice agencies work together as teams inside the different agencies. Teams are assembled to brainstorm and complete the tasks. For example, law enforcement agencies have specific teams to work certain cases. These team members must be able to work with each other so the team can be effective to solve the cases. Criminal Justice managers do not always have team members who can work together. Sometimes there is conflict within the team and the manager has to come up with a resolution if he or she wants this team to succeed. The team members must be compatible with each other to be effective. The responsibility lies on the criminal Justice managers to assemble the effective and compatible teams for the departments. He or she is faced with a challenge when conflict arises within that am, and he or she must figure out a solution, whether the solution is to remove one member of that team or design new teams (Collaborative Justice, 2012). Affecting Change for the Future The leaders in criminal Justice agencies face many challenges that he or she must deal with daily. The criminal Justice agencies must work together as a team instead of against each other to make the changes and embrace the changes. The future criminal Justice leaders will be confronted with bigger and more complicated before. Even though the challenges will be more complicated and acknowledged at a ore rapidly rate, the abilities these leaders must conquer will not change. The structure of the organization is determined by the economy within the departments of the organization. The structure also assists the organization on reaching the goal. The structure can have some parts that are considered weak. An example of a weakness was when parts of the structure such as open positions could cause more workload for other employee which is looked at as an overload, which would be looked at as a weakness. The human resource department has been labeled the area that handles the employee’s benefits, compensation, insurance and training for many years. Human resources are also responsible for finding the best person qualified to fill any open position that needs to be filled in the organization at all level. The criminal justice organization will constantly have to be changing for a few reasons which are the laws are always changing and the technology is always changing so the criminals are changing. Another issue that is part of the criminal justice organization is the fact that politics are very involved in criminal justice organizations. On a personal level, I am currently working in a criminal justice organization. There is a certain level of command that must be followed and a certain way that policies must be followed to the letter. The leaders in the criminal justice organization make sure that they work closely with all of the leaders of the different departments in the organization. The communication is essential for all of the leaders to do their job and for the goal to reach by everyone involved in the criminal justice organization. Resources: Carter McNamara, M. P. Answer: Introduction VF Brands Company is renowned for serving consumers with more than 30 brands trough several medium of distribution. Several brands of the company includes Jeanswear, image wear, contemporary brands, sportswear and outdoor and actions sports (Yu and Tseng 2014). The firm is focused on achieving sustainable, extended term growth driven by constant geographic expansion long with the companys wholesale partners and owned retail, acquisitions and product innovations. The objective of the report is to describe VF Brands supply chain along with its activities, partners, relationships and shareholders. Moreover, the two major brands or products of the along with the business needs of its consumers will be evaluated through assessing the effectiveness of its supply chain in meet business requirements (Gemp et al. 2014). The report evaluates the supply chain strategy of VF Brands international supply chain strategy. It was gathered that the company has employed a combination of in-house manufa cturing along with traditional arms-length sourcing arrangements. Illustration and Description of VFs Supply Chain Importance of VF Supply Chain Activities and its Link with Strategic Goals VF Brands has recently modified its supply chain strategy in which the company focused on producing apparels from its own plants and its huge suppliers network. Outsourcing strategy is one among the major supply chain activities of the company. This activity of VF Brands is focused on ensuring flexibility (Yang et al. 2015). Outsourcing activity also offers strong incentives for its suppliers in decreasing costs for competing with its upcoming contracts. Sourcing activities was developed for every single product of the company. This had to be done on several levels of its supply chain and not only for the final garment assemblage (Annese et al. 2014). Outsourcing supply chain activity facilitated VF Brands to identify its sources for raw materials, accessories and fabrics so that they are produced in cost effective manner and as per the demands of its consumers internationally. The company in consideration to their managerial also selected suppliers and technical capabilities along with expertise in particular garment segments of the brand (Tajabadi and Kazemi 2016). Another major activity of VF Brands supply chain is strategy of traditional sourcing and in-house manufacturing. This unique operations strategy offered the company a competitive advantage as all its competitors completely relied on outsourcing rather than any internal manufacturing (Altmann 2014). Such supply chain activity ensured that Brands internal manufacturing plants were observed to be among the best all over the world in respect of reliability, quality and efficiency. Building a superior quality supplier network is the third major supply chain activity of VF Brands. Under this activity, the prospective suppliers were required to be visited and their production capabilities were carefully evaluated. Such activity helped the company to meet its strategic goals of maintaining a strict policy of conducting business with the suppliers those followed globally renowned standards for employee safety and protection (Annese et al. 2014). This major supply chain activity facilitated the company in maintaining efficient working relationships with suppliers. The supply chain activities of VF Brands also included expansion of its product lines internationally with constant replenishment of fresh designs. The product designers of the company totally focused on generating a new range of fashion products that has the capability to address new consumer expectations (Lee and Kashmanian 2013). Business Requirements of VF the Brands Consumers have towards its Supply Chain The supply chain strategy of VF Brands is observed to be aligned with its major business requirements. The consumers of some of the major brands of VF Brands Company have certain business requirements that the brands must have towards the companys supply chain. Lee and Wrangler are deemed two major brands of VF Brands Company whose consumers have several business requirements from the supply chain of these brands (Lee and Kashmanian 2013). Because of the globalization of the supply chains of these two brands, VF Brands faced challenges regarding finding suppliers, coordinating product flows and managing sourcing relationships. The consumers of these two Jeanswear brands expected the companys supply chain offer fully integrated services to them. The consumers of these brands demanded quick service. In consideration to such expectations of the consumers of its lee and wrangler Jeanswear brands, VF Brands decided to manufacture 60% of its jeans in-house (Yang et al. 2015). These brands were greatly targeted within the US market that needed extremely quick response times and sourced a great range of the products under the brands internally. The consumers of these brands expected the companys Jeanswear brands such as lee and Wrangler to present classic product lines with new designs every year. To address such business requirements, VF Brands outsourced its supply chain activities such as raw materials gathering and manufacturing in order to minimize its inventory costs despite of presenting newly designed Jeanswear as per consumers expectations. The VF Brands attained huge experience with sourcing for its two major brands (Lee and Wrangler) (Annese et al. 2014). Considering this, its management team also started to realize that the companys supply chain network offered a considerable platform for business growth for these brands. Because of the considerable differences in the consumers product requirements for these brands across several regions of the world, all through the season VF Brands supply chain ensured to be extremely responsive to these needs. To address different needs of consumers in different regions, VF B rands supply chain management had developed planned internal and external capacity, managed inventory and streamlined manufacturing processes and product designs needed to go from fabric to finished goods on its entire stores shelf (Yang et al. 2015). Sourcing Arrangements and their Strategic Implications The Third way can be deemed as a partnership model, which includes arrangements of traditional sourcing and certain aspects of outsourcing and collaboration. It is revealed that the objective of such supply chain strategy is to develop a sourcing relationship that consist certain virtues of vertical integration with the sourcing flexibility (Kashmanian and Moore 2014). One among the three sourcing arrangements under the third way strategy is cut and make contracts. Under this sourcing arrangement approach, VF Brands tend to strike distinct contracts for its suppliers at every stage of the manufacturing process (components fabric, cutting, sewing, finishing, and washing) (Delke 2015). VF Brands Company owned the inventory and along with that, the suppliers were paid for the value added of their specific step. The Company was also accountable for coordinating the products flow from one supplier to another. The benefit of such approach is that it facilitated the company to maintain a gr eat control on the costs at every stage. CM contracts were mostly employed for heritage lines out of the Central American along with Carrabin suppliers and were managed in accordance with internal production operations (Papadopoulos et al. 2017). The second approach is package sourcing under which the suppliers of the company, an individual supply accepts of the responsibility for the overall process from the raw materials to the finished products and shipping them to the market. They were paid based on every single manufactured piece and had the responsibility of paying their sub-contractors, suppliers of raw materials along with logistic expenses (More and Subash Babu 2012). In such situation, VF Brands Company did not have any kind of materials ownership along the production process. Full package sourcing is the third approach that was generally used for the companys lifestyle brands all through its business units in Asia, Northern Africa and Europe. The third approach was to enhance the quality and reliability of the companys service that they received from the sourcing (Yu and Tseng 2014). These three sourcing arrangements within the VF Brand companys Third Way strategy is very effective in bringing down the expenses through continuously expanding the base of suppliers to the lower cost locations. An increasing focus on the low cost sourcing has enabled the company to attain its total corporate margin targets (10-15%) (Delke 2015). However, it is also believed that in consideration to its major sourcing arrangements VF Brands Company requires to shift its attention from searching the lower cost suppliers to better management of its suppliers base. Conclusion The objective of the report was to describe VF Brands supply chain along with its activities, partners, relationships and shareholders. The report evaluated the supply chain strategy of VF Brands international supply chain strategy. It was gathered that the company has employed a combination of in-house manufacturing along with traditional arms-length sourcing arrangements. It was gathered from the report that the major activity of VF Brands supply chain is strategy of traditional sourcing and in-house manufacturing. This unique operations strategy offered the company a competitive advantage as all its competitors completely relied on outsourcing rather than any internal manufacturing. It was also revealed that the objective of such supply chain strategy is to develop a sourcing relationship that consist certain virtues of vertical integration with the sourcing flexibility. Evaluation of the supply chain strategy finally depicted that VF Brand Companys Third Way strategy is very effe ctive in bringing down the expenses through continuously expanding the base of suppliers to the lower cost locations. Product Place Lush Location Strategy

Due to the unique characteristics of the Lush Company’s industry of operation, it is vital to balance the elements of intangibility, inseparability, and heterogeneity in the 4Ps of its market mix (Eldring, 2009).Advertising We will write a custom report sample on Product Place: Lush Location Strategy specifically for you for only $16.05 $11/page Learn More Therefore, it is important to establish means and ways of reaching the potential market consisting of sensitive clients through the following strategies. Online Placement Though currently operational, the company should redesign its online purchasing website to increase it visibility. The main objective and goal of this online marketing plan is to attract the young adults’ market bracket that spends nearly a quarter of a day online. This will be achieved through optimization of the company online portal website to improving on visibility of the products online. It is necessary to revise t he company’s online sales algorithms constantly for the search result for the company’s products to remain at the top. This can be achieved through revising the content to ensure that all the information in the website pertains directly to the needs of potential clients (West, Ford Ibrahim, 2010). Retail Stores In order to further the current market expansion strategy, the Lush Company should explore the option of franchising its products to smaller retail stores across the UK. Specifically, the kiosk model will increase the visibility of the company’s products to the low quantity purchasers. The retail stores will then use the parent company’s supply chain channels to reach out the market segment (Jobber, 2012). For instance, the company may use the services of the famous Iman Cosmetics distributors that have small retail stores across the UK.Advertising Looking for report on business economics? Let's see if we can help you! Get your first paper w ith 15% OFF Learn More Since the Iman’s distribution channel is well developed, the Lush Company will increase their product visibility in all regions where Iman Cosmetics distributors have retail stores. The current distribution channel of the Lush Company consists of 50 distributors with each selling an average of 100,000 products annually. Thus, an addition of 10 distributors will certainly increase the annual turnover by 100,000 products. In three years, the turnover will stabilise at 6,000,000 pieces of Lush beauty products, which is almost 20% increase in the market share. Thus, a 15% increase is very viable within three years. As the market share increases, Lush Company’s market visibility will also increase in the same proportion (Eldring 2009). Partnerships with the supermarkets Reflectively, all the supermarkets in London have store space for the cosmetic products. For instance, Sainsbury and Tesco stores have some of the largest shelves for cosmetic products. Thus, Lush Company may sign a memorandum of understanding with Sainsbury, Tesco and other supermarkets located within the cities of London, Bradford, Birmingham, and Peterborough among others. The memorandum of understanding will entail an agreement with the supermarkets to allocate special shelves for the Lush products besides running promotions on behalf of the company.Advertising We will write a custom report sample on Product Place: Lush Location Strategy specifically for you for only $16.05 $11/page Learn More In return, the supermarkets will retain an agreed percentage of returns from these products. When this strategy is successfully implemented, Lush Company will greatly increase its visibility in the above cities through its products in these supermarkets. Product distribution channel To further penetrate the expansive cosmetic industry of the UK, the Lush Company should improve its distribution network by adding a fleet of ten autom obile cosmetic shops that also acts as the source of transport for the company’s products to different stores and supermarkets (Wormeli, 2007). These automobiles will be fitted with visible posters of the company products. The automobiles will be allocated to different regions of the UK such as Truro, Wakefield, and Wolverhampton where the availability and visibility of the company’s products are minimal. In order to successfully implement this strategy, the Lush Company will have to double its current expenditure on product delivery to the market. However, this cost will substantially drop after a short period of time as the company will start to benefits from economies of scale as a result of dispatching more products into the market due to improved product visibility. Before You Were Mine Essay Example

Before You Were Mine Essay Example Before You Were Mine Paper Before You Were Mine Paper Before You Were Mine Carol Ann Duffy Duffy Is a poem about the adoration that the writer feels for her mother. Her feelings are revealed in first person. Duffy uses a range of narrative techniques like onomatopoeia, metaphors and short sentences which stand out and make the writers point clear. These techniques help reveal the authors changing attitude from selfish and possessive to loving and affectionate, when considering the younger version of her mother. After reading the poem, we learn that the writer Is looking at a photograph of her other and her friends when they were teenagers, standing at a street corner having a laugh, ready to go out for the night. Perhaps the author found this photo in among her mothers things and decided to write about what it represents. To her, it represents the fact that her Mother had a life before her and it was a pretty good one. The way the poet writes about her mother suggests that her mother had a very glamorous life and there are many ways Duffy tries to communicate this to us throughout the poem. In the photograph that Duffy has found, her mother is pictured n a polka-dot dress and Duffy compares her to Marilyn Monroe, the biggest film star and glamour model of the ass. The thousand eyes where the glitter ball hangs in the ballroom, the dancing and high-heeled red shoes and the polka-dot dress her mother would wear on a night out all add to the fun that comes with a glamorous life. The poet portrays quite a possessive attitude towards her mother. She constantly mentions herself and her own thoughts and feelings throughout the poem I remember. , Im not here yet. Im ten years away, the thought of me doesnt occur Even the title portrays the possessive way In which Duffy thinks of her mother: Before You Were Mine, The word mine lets the reader know that this woman is hers! Not anybody elses, except her husband of course, but thats In a deferent sense! This may be quite a selfish stance to take, but It shows the closeness of the mother and daughter relationship. Perhaps, the poet is possessive of her mother because she couldnt control her mothers youth and is hanging onto what she can control at the moment. As Duffy realizes the fun, exciting life her mother had before she gave birth to her, she feels a pang of guilt that she in a sense took away her mothers youth and freedom. When Duffy writes, l en cease enema AT my loud, possessive yell was ten Test one, Enron The words loud and yell suggest the scream of a baby when it comes out of its mothers womb and this portrays Carol Ann Duffy being born and ending the decade that was the best one for her mother. Duffy is relating to the good times her mother ad with her friends before she had a child and in a way forced her to grow up, move on, throw away her youth and adopt the lifestyle and responsibilities of a caring mum. As well as guilt, theres a sense of regret that Duffy didnt know her mother when her mother was fun exciting and vibrant. As she says, Even then I wanted the bold girl winking in Portable; somewhere in Scotland, before I was born. The use of the word bold suggests that the poet admires her mother for her confidence and daring behavior. Duffy regrets that she didnt know her mother hen she was the bold girl and perhaps feels guilty as she feels it was her fault her mothers behavior changed. The theme of love is captured throughout the poem. When Duffy says I knew you would dance like that, it shows that she has faith in her mother, cares for her and wants the best for her. The poet would love to meet the glamorous, care-free, dancer who only existed a decade ago, laughing on the corner of George Square. The poet uses alliteration at the end of the poem: Even then I wanted the bold girl winking in Portable, somewhere in Scotland, The words bold, before and born again suggest that her mother was bold before she was born and the poet uses the letter b to make these words stand out and add fluency to the poem. That glamorous love lasts where you sparkle and waltz and laugh before you were mine. This time the author uses the letter l to make the words love, lasts, and laugh, stand out. This suggests that the love she saw in the bold girl winking in Portable, is still there in her mother, and Duffy sees this every time her mother laughs. The poet has revealed her and her mothers relationship in a sweet and sensitive way, thinking carefully about her relationship with her mother in the present, the past and thinking about the relationship her and her mother could have had if the poet Ana Known near mother Detour seen gave Rite to near snarling stories tout near Mother teaching her dance steps on the way home from Mass, and how she always played with her Mums red high-heeled shoes suggests that her and her Mother had quite a warm and close relationship and reveals perhaps that Duffy was grateful for he great memories she had with her mother as a child. Reading this poem gets me thinking about my own relationship with my Mother and how her life was before me. I dont really relate to this poem at all because from what my Mom has told me I know that her life before she had me was far from glamorous so she didnt leave much behind and probably had a lot more fun when she had me! So the line at the end of my poem to my mother would be That glamorous love lasts where you sparkle and waltz and laugh after you were mine.

Compound Modifiers

Compound Modifiers Compound Modifiers Compound Modifiers By Daniel Scocco The compound modifier is my very favorite piece of the English language. It’s a hobby of mine to go around hyphenating word groupings that are modifying unbeknownst to them. Once you learn what it’s all about, you’ll do the same. But, what is a compound modifier, you ask. Well, let me tell you†¦ The rule Which would you rather read? She looked up at the green sky and shrunk away from the white lightning or She looked up at the eerie-green sky and shrunk away from the white-hot lightning. A compound modifier refers to two or more words expressing a single concept. Regular adjectives modify nouns all the time, but a compound modifier goes much further. His yellow-green teeth were visible beneath a salt-and-pepper mustache. The words yellow and green, and salt and pepper are adjectives modifying the nouns teeth and mustache. Since they appear before the noun, they are hyphenated. If they followed the noun, they would no longer be hyphenated. From underneath his mustache, which looked like salt and pepper, you could see his teeth of yellow and green. Exceptions The only time the compound modifier is not hyphenated ahead of the noun is if the word very or an adverb ending in ly is used. For instance: The very dark sky hovered over us versus The raven-black sky hovered over us. Sometimes the compound modifier does keep the hyphenation after the noun – when it follows a form of the verb to be. For example: The soup was water-thin, but delicious all the same. More examples The shelves were buckling under the weight of dust-covered books. Books covered in dust filled the buckling shelves. Books, which were dust-covered, filled the sprawling shelves. We followed the man through a poorly lit corridor. The room we entered was well-lit. We entered a well-lit room. We followed him into a room, well lit with candles and a fire. Cold War Essay Example | Topics and Well Written Essays - 2250 words

Cold War - Essay Example Soviet Union tried to empower communism all over the world while United States and its alliance supported many countries of the world to weaken the communism. After the end of World War II, the Soviet unions decided to spread communism all over the world. The United States determined to stop the spread of Soviet power and communism. For this purpose it provided much financial support to its alliance. The alliances were democracies that were not in favor of communists too. Though they were not able to stop the spread of communism in Eastern Europe, the U.S and Britain were determined to preserve Western Europe from the reach of communists. In the World War II Soviet Union has gained much popularity in the West Europe due to the resistance against the Nazi forces. So there was a chance of election of communist parties in France and Italy. Harry Trumann was the first US president started to fight the cold War. Britain was the first country that investigated for the nuclear weapons' development. In 1945, Britain was an activist world power. It possessed the second largest national navy, and its Empire-Commonwealth was genuinely global. The Dominions stretched from Canada to Australia, New Zealand and South Africa; it had colonial possessions from the north to the south of the African continent, to the east of Suez, in south and south-east Asia, as well as many scattered, and often strategic, island outposts. India was proclaimed as the 'jewel in the crown' of the Empire. A major problem for the historians analyzing the impact of military expenditure on the usual working of the economy of a country just after the war is the fact ignored by the liberal economic theory. This theoretical shortfall reflects the fact that the mobilization for industrial warfare can only be achieved through suspending the normal economic operation. While accepting necessity to plan the wartime economy, most British economists considered that after the hostilities and War activities, the resources will be allocated to the market as usual. This is what the liberal economists oppose. As a part of conversion, the British policy makers faced crucial situation about scaling down the Britain's efforts with its diminished economy and military power in the post war world. Alec Ciancross accepts that the Britain's Defence efforts may have been extraordinarily large and says that the real problem for Britain was the role it was asked to play was beyond its strength. But the other historians criticize the leadership of Britain who did not face the fact that Britain would not be able to meet the global military commitments. The question arises here is this that did the excessive military costs were responsible for low investment leading to weak economy of Britain Usually it seems to be answered that the short term expenses of the war would not affect the long term economy policies. Defence economists analyze short term and even small changes in the economy and

Nutrition - Coursework Example The brand contains some sugars, quality fibre, no fructose corn syrup, and high in calories. The organic and regular Red Delicious Apples defer in three aspects; taste, size, and nutrient value. Red Delicious Organic Apples come in large sizes but lack sweet taste and low in nutrient level as compared to the regular Red Delicious Apples. Non-Organic Red Delicious Apple costs $39 while one Organic Red Delicious Apple goes for $30. There exist six different types of peppers located in the Production Section. The types of peppers include large size Bell Pepper, Mexican heart-shaped Poblano, long and versatile Anaheim, very hot Serrano, and bulbous Habanero. Without any doubt, the longer the storage time, the faster the loss of nutrients in strawberries. In this scenario, a packet of fresh strawberries have higher nutrient levels as compared to large pre-packaged container of cut-strawberries. Hence, a pre-packaged container of cut-strawberries costs cheaper as compared to the other one. The serving size for pasta measures half a cup of cooked pasta. E-Library System Essay Example for Free

E-Library System Essay This chapter presents the software development methodology used by the researchers in the design and development of the proposed Online Library system of UCNHS, the scope and delimitation, the date gathering techniques, and the sources of data. Software Development Methodology The Modified Waterfall Model in software engineering came into existence because of the defects of the traditional Waterfall Model. The phases of the Modified Waterfall Model are similar to the traditional Model. The main change is that phases in the Modified Waterfall Model life Cycle are permitted to overlap. A lot of flexibility has been introduced in the Modified Waterfall Model in software engineering due to overlapping phases. At the same time, a number of tasks can function, concurrently, which ensures that the defects in the software are removed in the development stage itself and the over head cost of making changes to the software before implementation is saved. The Modified Waterfall Model is more relaxed approach to formal procedures, documents and reviews. It also reduces the huge bundle of documents. Due to the development team, the devote to work on the code has more time and does not have to bother about the procedures. The researchers used Modified Waterfall Model because documentation is produced at every stage of the software development. This makes understanding the product designing procedure, simpler and will closely work with the school and users to understand their needs. The figure below describes the structure and activities in the Modified Waterfall Model (Bhakti Satalkar, 2010). Requirement gathering and analysis System Design. Implementation Testing Maintenance Figure 2. Modified waterfall Model Requirement gathering and analysis. All possible requirements of the system to be developed are captured in this phase. Requirements are a set of functions and constraints that the end user (who will be using the system) expects from the system. The requirements are gathered from the end user at the start of the software development phase. These requirements are analyzed for their validity, and the possibility of incorporating the requirements in the system to be developed is also studied. Finally, a requirement specification document is created which serves the purpose of guideline for the next phase of the model. In this phase, the researchers gathered data that might be used in the proposed system and also through an interview with the library staff, performed observation to the transaction and conducted survey with students of Urdaneta City National High School. System Design. Before starting the actual coding phase, it is highly important to understand the requirements of the end user and also have an idea of how should the end product looks like. The requirement specifications from the first phase are studied in this phase and a system design is prepared. System design helps in specifying hardware and system requirements and also helps in defining the overall system architecture. The system design specifications serve as an input for the next phase of the model. In this phase, the researchers will use USE CASE, DFD, ERD to evaluate and design the system in accordance to the requirements needed. Implementation. On receiving system design documents, the work is divided in modules/units and actual coding is started. The system is first developed in small programs called units, which are integrated in the next phase. Each unit is developed and tested for its functionality; this is referred to as unit testing. Unit testing mainly verifies if the modules/units meet their specifications. The researchers will use visual basic 2010 as programming language to create and develop the system. Likewise, MS SQL as database is used as the back end to store, maintain and manage the database integrated to the system. Upon implementation, several testing will also be done to ensure that each module is working properly. Testing. As specified above, the system is first divided in units which are developed and tested for their functionalities. These units are integrated into a complete system during Integration phase and tested to check if all modules/units coordinate between each other and the system as a whole behaves as per the specifications. After successfully testing the software, it is delivered to the customer. In this phase, the researchers will test the system to ensure that the developed system functions are according to its requirements and to avoid errors. Maintenance. Inevitably the system will need maintenance. Software will definitely undergo change once it is delivered to the school library. There are many reasons for the change. Change could happen because of some unexpected input values into the system and it could directly affect the software operation. The software should be developed to accommodate changes that could happen during post implementation period. In case there are changes necessary it has to be fixed to make the system usable or to make it comply with the library staff wishes. In this phase, the researcher will instruct the librarian on how to operate and maintain the system. Meanwhile other features that will be implementing in this phase are beyond the limitation of the researchers. Scope and Delimitations This project covers the development of Digital Library System of Urdaneta City National High School. Specifically, it will cater all the processes done in inventory, borrowing, returning, and reservation of books. The Digital Library System of Urdaneta City National High School can access by the admin which is the Librarian, students in UCNHS, teachers of UCNHS and guest which is the alumni and students from different schools. Guest can only inquire for books availability and reserve it personally. However, the proposed system limits on the contents of book that can be viewed digitally, only the title page, table of contents and its overview are applied. Only the students and teachers are allowed to reserve and borrow book through online. The guest is not allowed to reserve books through online. Teachers and students referral is not included in the system. Data Gathering Techniques The researchers gathered information of the system through structured interview, questionnaire and document analysis to the UCNHS library staff and students. The use of references allowed additional information about software and system Requirements as well as how some organizations use the Internet in making achieves for records that later becomes a collective library on the internet. Structured Interview. Means of collecting data for a statistical survey. In this case, the data is collected by an interviewer rather than through a self-administered questionnaire. Interviewers read the questions exactly as they appear on the survey questionnaire. The choice of answers to the questions is often fixed (close-ended) in advance, though open-ended questions can also be included within a structured interview. In a series of interviews, researchers knew exactly what information are needed and prepared a list of pre-determined question that will be asking to the respondents. The researchers gather some viewpoints of the people around the system that could make more efficient particularly to library and employees. Document Analysis. Technique used to gather requirements during the requirements elicitation phase of a project. It describes the act of reviewing the existing documentation of comparable business processes or systems in order to extract pieces of information that are relevant to the current project, and therefore should be consider projects requirements. In support to the structured interview, the researchers gathered and examined thoroughly the existing documents like catalogue, logbook, and book card. Questionnaire. Research instrument consisting of a series of questions and other prompts for the purpose of gathering information from respondents. Although they are often designed for statistical analysis of the responses, this is not always the case. Questionnaires will be distributed to the students as input to the design of the proposed system. Likewise, with their feedbacks, features can be determined. Sources of data The Librarian, Library staff and students were interviewed as primary respondents. Also books and thesis manuscript were used to determine other requirements of the propose system. The researchers used websites, online libraries and other similar studies as references in this study. In addition to this, the researchers will distribute questionnaires to the Urdaneta National High School students to get information that will help in the progress of the development of the project study. Table 1: List of Respondents RESPONDENTS| NUMBER OF RESPONDENT| Librarian| 1| Library Staff| 2| Students| 100| Teachers| 50| Total| 153|.

Essay --

Critical Lens Essay John Steinbeck once stated, â€Å"It is the responsibility of the writer to expose our many grievous faults and failures and to hold up to the light our dark and dangerous dreams, for the purpose of improvement.† In others words, people should expose the many flaws and failures that every human has. By revealing them and making it eye-catching, that person can recognize that flaw and work to improve their flaws and failures. The journalistic novel Random Family by Adriene Nicole LeBlanc and the non-fiction novel Friday Night Lights by H.G. Bissinger both reveal that true mental and emotional freedom is dependent on finding a solution for your defects and deficiency. The literary elements used to prove this quote was conflict and irony. The novel Friday Night Lights by H.G Bissinger illustrates how a person’s failures can deeply affect others negatively. For example, the conflict was a person to person---fight between two people because Charlie is angry with his son Don for failing to hold the football during a game or practice. Charlie expresses how he feels by interr...

Wembley vs Emirates Football Stadiums

Construction of Wembley stadium was supposed to be completed by May 2006, but completed in March 2007. There were several controversial between client, contractor, sub contractor, designer etc. and some cases end up in the court. The causes for these controversial were identified mainly due to adversarial contracts, unreasonable risk allocation, cash-flow problems, design changes, poor performance, poor site management and litigations.Several reasons were adduced for the successful delivery of the Emirates football stadium but the most overarching and notable of the reasons was the effective and selective supply chain created by the main contractor (Exceptional Performer, 2007). In both case studies one can clearly see good and bad practices demonstrated. While both cased had the same procurement routes, with only slight modifications to allow client to have greater input in design, they both had different outcomes. In all respects the Emirates Stadium is surely the winner as the mos t successfully executed project of the two.In both cases there were many challenges as well but it is how they were met with that determined their fate. The Wembley Stadium case was clearly a disaster in planning, financing and execution. This may be attributed to the lack of knowledge and experience on the part of the contractor, Mutliplex about the UK construction industry, which is why they possibly formed a consortium with Bovis in the beginning. Due to lack of a firm establishment in the UK industry, Multiplex was faced with much distrust from locally well established firms. The fact that so many disputes arose in terms of payments and court proceedings did not help much either. The Emirates Stadium on the other hand was a perfect example of best practice. They incorporated sustainability, collaborative working, and effective and selective supply chain management. The supply chain was a crucial ingredient that Sir Robert McAlpine had established through experience in the UK indu stry while working with various subcontractors and forming strong ties with them. This strong ties and trust between contractor and subcontractors was lacking in the Wembley case. However, contractors alone are not to bare the blame the construction clients have a role in the success of a project as well. In the Wembley case the construction client mismanaged money by expending too much in investigations and reviews. They also pointlessly hired management consultants and did not heed their advice. Therefore, the client’s attitude towards contractor selection is imperative and can lead to project failure if not done properly. This was the case in the Wembley Stadium where the Australian contractor was rushed into agreement. In the end collaborative working and an effective supply chain coupled with a proper decision making client are vital ingredients for a project to be executed effectively and efficiently. From the literature review found that, projects suited to GMP had the f ollowing characteristics; †¢ Cost certainty was a primary objective †¢ Time was a primary objective †¢ The scope was fully defined †¢ The project was simple †¢ It was a development project †¢ The parties had previous experience in GMP contracts †¢ There was a good team based relationship between the parties †¢ The personalities were appropriate (fair, reasonable and empathetic)

Psychology, IT and Individualism Essay

As information technology continues to develop with more people getting exposed to it, numerous changes are also taking place the field of psychology. Previously, many IT analysts frequently argued that psychology was taking longer than enough to implement and adopt technological advancements. However, recent researches indicate that the practices and methods applied in psychology have greatly transformed as a result of changes in information technology. First, the internet has been one of the major latest trends in psychology; it is highly associated with psychopathology (Wilson 2004). For instance, depression and loneliness have often been connected to the excess use of the internet since it results to addiction. Secondly, there is the use of information technology in counseling and psychotherapy. This is currently being done via the internet; this has resulted to some lack of privacy and confidentiality as well as loss of effectiveness in the practice since some important features such as facial expression and verbal expression has been lost (Wilson 2004). IT is also applied in research and development in psychology to enhance further growth and generation of useful knowledge. For instance, the authors of the current DSM IV-TR applied computerized criteria in revising the classification of disorders in the manual to come with a less flawless criterion of categorizing disorders and disabilities. Using IT, today’s psychotherapists have been able to make numerous improvements in the way through which they can reach, counsel and correspond with their clients (discussed in the next section) (Azucena, Hunter, 2001). The growth of Psychotherapy Psychotherapy refers to private individual counseling by professional psychotherapists. As a highly growing trend in psychology, psychotherapy is used by psychotherapists to assist them in developing deliberate interpersonal relationships with their clients as a strategy for helping the patient to improve their well being. The trend applies many modern techniques of building closer relationships with the patients such as face to face dialogues, home phone calls and regular visits of the therapist to the client (Azucena, Hunter, 2001). This trend is basically aimed at improving the mental health of the patient through interpersonal relationships. This represents a great shift in the nature of counseling psychology, psychiatry, occupational therapy, clinical psychology and other related fields in psychology. In essence, psychotherapy is not a new trend in the field of psychology since over the years, people have received private reassurance and counsel from others; what is new and becoming increasingly famous in psychology is the application of modern and deliberate professional techniques in psychotherapy. Such psychotherapeutic techniques include online counseling whereby a therapist handles client personally through creating client accounts where he can easily relate with the client on one-on-one(but not face-to-face) bases (Tredinnick, Fowers, 1999). Most of the new psychotherapeutic techniques are possible because of the advancements in the use of information technology in the field of psychology as discussed above. For instance, therapists encourage clients to use social networks to be able to communicate easily with them and their families. In addition, they also approve the use of phone calls whereby clients are free to call their physicians at any time of the day so that they can discuss their issues at convenience. However, modern psychotherapy is not without a number of flaws. Recently, concerns have greatly risen concerning the advancement of individualism in psychotherapy (Tredinnick, Fowers, 1999). Psychotherapy encourages individualism on both the therapist and the client. Individualism is a term used in psychology to refer to ways through which people recognize themselves only and concentrate on individual goals as opposed to collectivism. In this sense, psychotherapist no longer view psychotherapy as a collective discipline that require combined efforts with other experts in the field since they are in a position to carry out counseling and psychiatry without involving anybody else—they can visit their clients at home, chat with them online and make home phone class with them. This has resulted to a great decline in the success of psychology as a collective discipline (Tredinnick, Fowers, 1999; Azucena, Hunter, 2001). Conclusion The use IT in psychology and the advancement in psychotherapy are important developments in psychology and should be highly encouraged. However, it is upon therapists and other psychological professionals to ensure that this new trends are used effectively to prevent the decline evident in cooperation among professional bodies in the field of psychology due to individualism. George Washington Carver essays

George Washington Carver essays George Washington Carver was famous for his extraordinary work as a botanist. His research and development led to the development of over 300 products. Those include bleach, ink, chili sauce, and paper, plastic, only to name a few. However Carver was only granted patents for 3, those were cosmetic processing, and two different patents for paints and stains. Carver is also known as the savior of southern agriculture because he single handedly convinced congress to put a tariff on peanut imports to protect southern farmers. Further more in 1916 carver was asked to join the USDA because of his extensive insight on farming techniques and skills. Carver was also the first to discover a solution to the damage the crop cotton did to the soil and how to replenish it. His solution was called crop rotation, this worked by getting rid of the entire cotton crop after its growing season then replacing it with a crop that gave the nutrients back to the soil. Carver also did essential discoveries in the medical fields as well. Penol was a medication Carver developed that came from creosote and peanuts designed to treat tuberculosis and chronic bronchitis. However it was only successful for a few years. Industrial developments were also a part of his research. With such developments as making paper from peanuts, created synthetic marble from wood shavings, used cotton in several road-paving processes, made artificial rubber out of sweet potatoes, also a few cosmetic products. And for almost half of his life he did all of this research and development at Tuskegee Institute. 1. All of Georges personality traits helped him in his success but only a few made him famous. From an early age George had an insatiable hunger for knowledge and learning and was always searching of new ways to broaden his education. Also Carver had outstanding people skills. His charm, politeness, and sense of humo...

Ser Conjugation in Spanish, Translation, Examples

Ser Conjugation in Spanish, Translation, Examples The verb ser  is one of the  two  Spanish  verbs that mean to be.  The other one is the verb  estar. The verb  ser  is irregular, meaning  it does not follow a common  conjugation  pattern. In fact, ser is one of the most irregularly conjugated verbs in Spanish. Many of the conjugated forms dont even begin with s, and some forms are shared with the highly irregular verb ir (to go). This article includes  the  ser conjugations in the present, past, conditional and future indicative, the present and past subjunctive, the imperative, and other verb forms. Using the Verb Ser Ser  and  estar  are some of the most commonly used verbs in Spanish. Although they both mean to be, they are used in very different contexts. Ser is often used to talk about inherent or permanent characteristics. For example,  Ella es alta e inteligente (She is tall and smart). It is also used to talk about someones profession or occupation, as in Ella es doctora y à ©l es arquitecto (She is a doctor and he is an engineer), or to talk about where someone is from, as in El profesor es de Puerto Rico (The professor is from Puerto Rico). Ser can be used to talk about what something is made of, as in La puerta es de madera (The door is made of wood), or to talk about the location of an event, such as a meeting, party, festival, etc. For example,  La reunià ³n es en la oficina del doctor  (The meeting is in the doctors office). This verb is also used to talk about belonging. For example, La casa es de Alberto (The house is Albertos). Another use of the verb  ser  is in the passive voice, followed by the present participle, as in La tarea es hecha por el estudiante (The homework is done by the student). Yet another use of the verb ser is with impersonal expressions, such as Es necesario trabajar duro (It is necessary to work hard). Notice that in Spanish we do not use the verb ser to talk about someones age like we do in English (She is ten years old), but instead we use the verb tener to talk about how many years someone has (Ella tiene diez aà ±os). Ser Present Indicative The conjugations for ser in the present indicative tense are totally irregular. The first person singular conjugation soy is similar to other verbs like dar (doy), estar (estoy) and ir (voy). Yo soy I am Yo soy estudiante en la universidad. Tà º eres You are Tà º eres muy lista. Usted/à ©l/ella es You/he/she is Ella es doctora. Nosotros somos We are Nosotros somos buenos amigos. Vosotros sois You are Vosotros sois muy delgados. Ustedes/ellos/ellas son You/they are Ellos son personas trabajadoras. Ser Preterite Indicative The preterite tense conjugations of ser are also irregular, since they do not resemble the infinitive ser at all. Note that these conjugations are the exact same conjugations for the preterite indicative tense of the verb ir (to go). From context, you would be able to tell if you are talking about being or going. Yo fui I was Yo fui estudiante en la universidad. Tà º fuiste You were Tà º fuiste muy lista. Usted/à ©l/ella fue You/he/she was Ella fue doctora. Nosotros fuimos We were Nosotros fuimos buenos amigos. Vosotros fuisteis You were Vosotros fuisteis muy delgados. Ustedes/ellos/ellas fueron You/they were Ellos fueron personas trabajadoras. Ser Imperfect Indicative Ser is one of the few verbs that are irregular in the imperfect tense, since it does not use either of the usual imperfect conjugation endings (à a or aba). Remember that the imperfect tense can be translated as was being or used to be. Yo era I used to be Yo era estudiante en la universidad. Tà º eras You used to be Tà º eras muy lista. Usted/à ©l/ella era You/he/she used to be Ella era doctora. Nosotros à ©ramos We used to be Nosotros à ©ramos buenos amigos. Vosotros erais You used to be Vosotros eraismuy delgados. Ustedes/ellos/ellas eran You/they used to be Ellos eran personas trabajadoras. Ser Future Indicative The future indicative tense is conjugated regularly, since you can start with the infinitive (ser) and add the future tense endings (à ©, s, , emos, is, n). Yo serà © I will be Yo serà © estudiante en la universidad. Tà º sers You will be Tà º sers muy lista. Usted/à ©l/ella ser You/he/she will be Ella ser doctora. Nosotros seremos We will be Nosotros seremos buenos amigos. Vosotros serà ©is You will be Vosotros serà ©ismuy delgados. Ustedes/ellos/ellas sern You/theywill be Ellos sern personas trabajadoras. Ser Periphrastic  Future Indicative   The periphrastic future is formed with three components: the present indicative conjugation of the verb ir (to go), the preposition a, and the infinitive ser. Yo voy a ser I am going to be Yo voya ser estudiante en la universidad. Tà º vasa ser You are going to be Tà º vasa ser muy lista. Usted/à ©l/ella vaa ser You/he/she are going to be Ella vaa ser doctora. Nosotros vamosa ser We are going tobe Nosotros vamosa ser buenos amigos. Vosotros vaisa ser You are going tobe Vosotros vaisa ser muy delgados. Ustedes/ellos/ellas vana ser You/theyare going tobe Ellos vana ser personas trabajadoras. Ser Present Progressive/Gerund Form The gerund  or present participle is formed with the stem of the verb and the ending -iendo (for -er and -ir verbs). It can be used to form progressive tenses like the present progressive, which is usually accompanied by the auxiliary verb estar. Present Progressive ofSer est siendo She is being Ella est siendo una buena doctora al cuidar de sus pacientes. Ser Past Participle The past participle is used to form perfect tenses like the present perfect, which is formed with the auxiliary verb haber and the past participle sido. Present Perfect ofSer ha sido She has been Ella ha sido doctora durante toda su carrera. Ser Conditional Indicative The conditional tense is normally translated to English as would verb. It is formed regularly like the future tense, by starting with the infinitive form and adding the conditional endings. Yo serà a I will be Yo serà a estudiante en la universidad si me hubieran admitido. Tà º serà as You will be Tà º serà as muy lista si estudiaras ms. Usted/à ©l/ella serà a You/he/she will be Ella serà a doctora si no hubiera estudiado leyes. Nosotros serà amos We will be Nosotros serà amos buenos amigos si vivià ©ramos ms cerca. Vosotros serà ais You will be Vosotros serà aismuy delgados si hicierais dieta. Ustedes/ellos/ellas serà an You/theywill be Ellos serà an personas trabajadoras si quisieran. Ser Present Subjunctive The conjugation of the present subjunctive of ser is completely irregular. Que yo sea That I be Mi madre quiere que yo sea estudiante en la universidad. Que tà º seas That you be A la maestra le encanta que tà º seas muy lista. Que usted/à ©l/ella sea That you/he/she be Pap espera que ella sea doctora. Que nosotros seamos That we be El consejero quiere que nosotros seamos buenos amigos. Que vosotros seis That you be El mà ©dico recomienda que vosotros seismuy delgados. Que ustedes/ellos/ellas sean That you/they be El jefe espera que ellos sean personas trabajadoras. Ser Imperfect Subjunctive You can conjugate the imperfect subjunctive in two different ways, both considered correct. Option 1 Que yo fuera That I were Mam querà a que yo fuera estudiante en la universidad. Que tà º fueras That you were A la maestra le encantaba que tà º fueras muy lista. Que usted/à ©l/ella fuera that you/he/she were Pap esperaba que ella fuera doctora. Que nosotros fuà ©ramos That we were El consejero querà a que nosotros fuà ©ramos buenos amigos. Que vosotros fuerais That you were El mà ©dico recomendaba que vosotros fuerais muy delgados. Que ustedes/ellos/ellas fueran That you/they were El jefe esperaba que ellos fueran personas trabajadoras. Option 2 Que yo fuese That I were Mam querà a que yo fuese estudiante en la universidad. Que tà º fueses That you were A la maestra le encantaba que tà º fueses muy lista. Que usted/à ©l/ella fuese that you/he/she were Pap esperaba que ella fuese doctora. Que nosotros fuà ©semos That we were El consejero querà a que nosotros fuà ©semos buenos amigos. Que vosotros fueseis That you were El mà ©dico recomendaba que vosotros fueseis muy delgados. Que ustedes/ellos/ellas fuesen That you/they were El jefe esperaba que ellos fuesen personas trabajadoras. Ser Imperative The imperative mood is used to give commands or orders. The tables below show both positive and negative commands. Positive commands Tà º sà © Be!  ¡Sà © muy lista! Usted sea Be!  ¡Sea doctora! Nosotros seamos Let's be!  ¡Seamos buenos amigos! Vosotros sed Be!  ¡Sed muy delgados! Ustedes sean Be!  ¡Sean personas trabajadoras! Negative commands Tà º no seas Don't be!  ¡No seas muy lista! Usted no sea Don't be!  ¡No sea doctora! Nosotros no seamos Let's not be!  ¡No seamos buenos amigos! Vosotros no seis Don't be!  ¡No seis muy delgados! Ustedes no sean Don't be!  ¡No sean personas trabajadoras!

Business law - Essay Example There are three main approaches to statutory interpretation, also known as canons. The first is the textual canon which gives rules for interpreting legislation as written. For example, one of the textual canons suggests that anything not mentioned on a list given in a statute is not included in the law. The second is the substantive category, which includes canons that promote the judge to favour specific results or judgements. For example, this includes the Charming Betsy canon, stating that decisions made should not conflict with international law, based upon Murray v. The Charming Betsy (Steele, 2007). Finally, there are a group of deference canons, which allow the court to defer to another authority when using interpretation (Steele, 2007), such as the UK Supreme Court. Question 3 Prior to the Human Rights Act 1998, European Convention was not a source of rights (Steele, 2007), and was not allowed to be used for statutory interpretation in many cases (Steele, 2007). The Human Ri ghts Act 1998 has now made it obligatory for courts to interpret the UK legislation in a way that fits in with European Convention rights (as in the substantive category of canons). This effect can be seen in cases such as Venables and Thompson v. News Group Newspapers [2001] 1 All ER 908 (Clarkson et al, 2008). ... This is also applicable in areas where case law is the source of law because there are no legislative pieces that adequately allow the judge to come to a decision (Gruner, 2004). The strength of binding judicial precedent is that it allows decisions to be made based on previous cases without excessive need for interpretation. However, it does take the focus away from the facts of the case in hand which may cause a wrong decision to be made. Task Two Question 1 The exception to the general rule that a corporation is criminally liable occurs in cases where either the crime or the punishment cannot be committed by or served by a company. For example, in the case of R v ICR Haulage Co Ltd [1944] KB 551 (Gruner, 2004), the company was convicted of a common law conspiracy to defraud. However, it was decided that the company as an entity cannot ‘conspire’ as it does not possess mens rea (Gruner, 2004). Additionally, as the punishment for murder is life imprisonment, a company c annot be convicted as it would not be applicable to an organization. Question 2 Using the principle of identification is difficult in some cases when dealing with business law. For example, a company cannot be convicted of manslaughter without some proof that a directing or leading mind behind the company is the reason for this gross negligence, then the prosecution will fail. The main issue with this is that the directing mind has proven to be extremely difficult to identify in many companies (Laufer, 2008), and only 7 of the 34 work-related manslaughter cases brought since 1997 have succeeded (Select Committee on Home Affairs and Work and Pensions First Report, 2004). To illustrate this, in the case
